Child Custody – A parent can request a modification if that parent relocates or if that parent has a significant change in his or her lifestyle. Child custody modifications can also be made if the parent with less parenting time wants more time their kid. The court will take numerous factors into consideration before rendering a decision either in favor or against the modification.
Child Support – If one of the parents has a significant change in income or lifestyle, the court may grant a modification to child support. A significant change could mean anything from getting a big raise or losing a job to an increase or decrease in assets. Sometimes one parent may come into money through an inheritance or trust. This can change the whole game when it comes to child support.
Spousal Support – Permanent spousal support can be modified if either or both of the spouses have a drastic change in circumstances – health, ability to earn a living, financial needs, etc. A request to modify spousal support will more than likely be modified through litigation. But, in some cases, both parties can come to an agreement without having to bring the court into the situation.
